Will the evaluation guarantee a specific outcome?

THE SAP PROCESS, EXPLAINED CLEARLY

A DOT violation begins a federally regulated process. The Substance Abuse Professional (SAP) evaluates the employee, recommends education or treatment, and later determines whether the employee has demonstrated compliance — a required step before returning to safety-sensitive duty.

The first appointment includes a clinical interview, a review of the violation and relevant documents, and standardized screening or assessment methods to understand the full picture — not just the incident itself.

Follow-up evaluation

Return-to-duty and follow-up testing

After the SAP reports successful compliance, the employer may arrange a directly observed return-to-duty test. Follow-up testing is also directly observed and runs separately from the employer's regular random testing program.

Common Questions

Before you begin

In most cases, yes — DOT regulations don't require your employer to select the SAP for you. You can choose a DOT-qualified SAP directly, though your employer may have a preferred provider list you're welcome to consider as well.
It depends entirely on the recommendation. An education-only recommendation might close out in a few weeks. A treatment recommendation, especially inpatient care, can take several months before the follow-up evaluation is even possible. Follow-up testing itself extends for up to 5 years afterward.
No. The SAP's role is to evaluate and report on compliance with the recommended program — reinstatement is entirely the employer's decision. Successful completion is typically a prerequisite for return to safety-sensitive duty, but it isn't a guarantee of employment.
The SAP cannot report compliance until the recommendation is complete. There's no penalty for the process taking longer, but you won't be eligible for a return-to-duty test until the follow-up evaluation confirms compliance.
Non-DOT evaluations follow a similar clinical structure, but they're governed by your employer's own policy rather than 49 CFR Part 40, so specific requirements — including follow-up testing rules — can differ. We'll walk you through the difference in your first appointment.

Rescheduling

  • Appointments may be rescheduled at no charge with at least 24 hours’ notice.
  • Missed appointments and cancellations with less than 24 hours’ notice may require a rebooking fee of [$AMOUNT].

DOT SAP services

The SAP program fee covers the initial evaluation, the recommendation, and the follow-up evaluation as described at booking. It does not cover education or treatment programs completed with outside providers, return-to-duty or follow-up testing, or employer or Clearinghouse fees.

If NewLeaf must cancel or reschedule an appointment, you will be offered the next available appointment time.

How your records are protected

NewLeaf maintains records related to substance use disorder evaluation, assessment, counseling, and referral. The confidentiality of these records is protected by federal regulations at 42 CFR Part 2 and by HIPAA. In general, NewLeaf may not tell anyone outside the practice that you are a client, or disclose information identifying you as a person with a substance use disorder, unless:

  • You consent in writing;
  • The disclosure is allowed by a court order that meets federal confidentiality requirements; or
  • The disclosure is otherwise permitted by the regulations — for example, to medical personnel in a genuine medical emergency, or to qualified personnel for research, audit, or program evaluation.

Violation of the federal law and regulations by a program is a crime, and suspected violations may be reported to the appropriate authorities in accordance with federal regulations.

What confidentiality does not cover

Federal law does not protect information about a crime committed by a client at the program or against program personnel, or a threat to commit such a crime. It also does not prevent reporting of suspected child abuse or neglect under state law to appropriate authorities.

DOT SAP evaluations

DOT SAP services operate under 49 CFR Part 40, which requires specific communication between the SAP, the employer or designated employer representative, and, where applicable, the FMCSA Clearinghouse. When you begin the SAP process, the required scope of these communications is explained and documented before the evaluation.

Court-ordered and third-party assessments

When an assessment is completed for a court, attorney, probation officer, employer, or licensing body, reports are released only to the recipients you authorize in writing, or as required by a qualifying court order. You will know before the appointment who will receive the report.

  • Request access to and copies of your records as permitted by law
  • Request amendments or restrictions on certain uses and disclosures

Supervision, consultation, and documentation review do not replace the counselor’s responsibility to follow applicable laws, board requirements, and agency policies; practice within their credential; protect client confidentiality; obtain emergency assistance when needed; and ensure clinical documentation is accurate. Consultation does not transfer responsibility for the client’s care — the counselor or agency remains responsible for final clinical decisions, documentation, treatment, referrals, and compliance.
